Terms of Service
These Terms are an agreement between you and NextEmbers LLC ("NextEmbers", "we") for using the app, the agent panel and nextembers.com. By using them you accept these Terms and our Privacy Policy.
Who can use the app
- You must be at least 18 years old and legally able to agree to these Terms.
- You may not use the app if you are in a country under comprehensive US sanctions or are on a US or international sanctions list.
- Keep your account details private. You are responsible for what happens on your account. One person, one account, unless we allow otherwise.
Content and conduct
You own the content you post, and you give NextEmbers a worldwide, non-exclusive, royalty-free license to host, show, record and distribute it to run and promote the app. You must not:
- show nudity or sexual content, or anything involving minors;
- harass, threaten, or promote hatred or violence;
- scam people, use stolen payment methods, or create fake accounts;
- buy or sell diamonds or accounts outside the official recharge agent program;
- stream content you don't have the rights to;
- break any law that applies to you.
We may remove content, limit features or suspend accounts that break these rules.
Diamonds and gifts
- Diamonds are a virtual item. When you buy them, you get a limited, revocable license to use them in the app. They are not money, have no cash value, and cannot be exchanged for cash, except host earnings paid through our payout process.
- Diamonds can be bought in the app through Apple or Google, or from an authorized recharge agent. Diamonds from anyone else may be removed.
- Gifts sent with diamonds are final once delivered.
- Purchases are non-refundable except as described in our Refund Policy or required by law. If a payment is reversed or charged back, we may remove the diamonds and anything bought with them, and suspend the account.
- We may change diamond prices, gift prices and features. Unused diamonds have no value if your account is closed for breaking these Terms.
Hosts and agencies
Hosts who receive gifts may earn points that can be paid out under the host and agency rules shown in the app. Earnings can be held or cancelled if they come from fraud, self-gifting, fake accounts or reversed payments. Hosts and agencies are responsible for their own taxes.
Recharge agents
Recharge agents are independent businesses, not employees or representatives of NextEmbers. They must accept the agent agreement and the rules on the agent program page. Payments between agents and their customers are between them; NextEmbers is not a party to them, but we keep a log of every diamond transfer.
Ending your account
You can delete your account at any time in the app. We may suspend or close accounts that break these Terms or the law, or to protect users. Sections on diamonds, disclaimers, liability and law continue after your account ends.
Disclaimers and liability
The app is provided "as is". We don't guarantee it will always be available or error-free. To the extent the law allows, NextEmbers is not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
Law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules. Before filing a claim, contact us so we can try to resolve it. Disputes will be heard in the state or federal courts located in Virginia, unless the law where you live gives you the right to bring a claim locally.
Changes
We may update these Terms. For meaningful changes, we will tell you in the app before they take effect. If you keep using the app after that, the new Terms apply.
